Some Texas Home Foreclosure Options You May Have Available to You

If your home is in foreclosure, or if you are behind on your mortgage payments and the bank or mortgage company is unwilling to work with you, you may have several options:

  • Option 1: Workout a solution outside of bankruptcy. A non-bankruptcy solution may be a workout outside of bankruptcy, such as renegotiating the terms of your mortgage, securing other financing, or working with your bank or mortgage company to piece together a plan for getting you caught up on your payments.
  • Option 2: Bankruptcy. A Chapter 13 bankruptcy may be a viable option to buy you the time you need to sell your home for a better price than a bank would get at a foreclosure sale. A Chapter 13 plan may also give you the time you need to get caught up with your mortgage arrearage if you want to keep your home. Generally, you will have three to five years to catch up on back mortgage payments, and you may actually lower other payments (such as credit card debt) to help make getting caught up on your house payment easier. In either event, a Chapter 13 bankruptcy will stop a foreclosure proceeding.
  • Option 3: Do nothing. Doing nothing may actually be a viable option. If you owe much more on your home than your home is currently worth, it may be in your best interest to do nothing, let the bank or mortgage company foreclose, and then utilize the bankruptcy laws (either Chapter 7 bankruptcy or Chapter 13 bankruptcy) to address any unsecured debt remaining from the home foreclosure and gain a fresh start.
